illegal to be naked in your own home

A Springfield, Virginia man is facing an indecent exposure charge after a passerby spotted the man naked in his kitchen and reported it to police.

Eric Williamson, 29, is a commercial diver who grew up in Hawaii and rents home with several co-workers. Williamson told FOX 5's Will Thomas his roommates were not home and he walked into the kitchen to make coffee about 5:30 a.m. Monday.

I'll laugh if this reaches any higher courts.
    ...and that's why.

Case'll be dropped. It'll be incredibly easy to argue that at 5:30am it was reasonable for him to expect noone would see him during the probably short period of time he was visible through the window. This case notwithstanding it should be illegal to be naked in your house in an area that unsuspecting passersby would see you. If you're away from open windows though, knock yourself out.

Why? If you don't want to see me naked, don't look through my window.

Indecent exposure laws vary from state to state but generally any showing of genitalia without the consent of the viewer is indecent. Some houses are closer to the sidewalk than others so it may be possible to inadvertently see someone 30' away with their windows wide open.

I never understood people's aversion to curtains. Riding around my neighborhood there's like 30 houses where the curtains are open all hours of the day. I can see someone's entire family gathered around the couch watching Sunday night football on their big screen. During the day it's pretty hard to see inside glass from a long distance due to glare but in the evening and with lights on you can see everything. Are people so lazy/allergic to curtains that they don't care that anyone driving by can see them go about their business???

                This is news?

Even if you're naked in your own home, if other people can see you from the outside it's still considered indecent exposure.

It shouldn't be. They're just body parts. Now if you're standing in the window gyrating your hips in a circular motion at passersby, that sounds like indecent exposure.

The worst part of this story is that the lady was cutting through his yard, but anyway...

Okay, also please be overweight when you stand near your windows naked~~

I don't disagree with it still being indecent exposure, but I do think it's awfully silly to actually call the cops about it.

Not just from state to state, but from municipality to municipality. The state of Vermont has not indecent exposure laws, but its municipalities do (not sure if all do). Also, concerning your wording of indecent exposure, it's a double-edge sword for men if a state writes its indecent exposure law as the "showing of genitalia without the consent of the viewer." Bad for men in the obvious way, but good for men because women can walk around naked in public, and as long as no one sees the pink, it's perfectly legal, as is the case in Maine.

Some other interpretations of indecent exposure:
-Some states require the exposure be with lewd intent.
-Some require the exposure to cause alarm or affront.
-Some towns have banned all public nudity, even breast feeding in public.
-In Iowa (from the case State v. Martin), "the crime [indecent exposure] as defined by the statute does not require that the exposure shall be made in the actual sight of any person...if a case should be made by confession, corroborated by circumstances, a defendant might properly be convicted of this offense, although no person witnessed the indecent act."

Also, in probably most cases, even if you were both in your house and you exposed yourself to your unwilling friend, it's indecent exposure. Private property has nothing to do with it.

"24-year-old Dorothy Maize was charged with indecent exposure last saturday when Paul Weizcrek, 46, climbed onto a ladder by her bedroom window and photographer her changing.

"I was exposed to her nudity for a good three minutes," says Paul, who refuses to state his place of residence. "I am deeply offended. After making several back-ups of the pictures, I deleted them off my memory card."

"I just don't understand!" says Dorothy, "I was just changing to go to bed. It was around 2:00 AM. And I looked out my window and saw - this man, standing on a ladder. He was taking pictures, and then he started lifting children out of his car and holding them in front of the window so they could see me. I just don't understand!"

"Although authorities have stated that Paul crashed his car into the side of Dorothy's house, a police spokesperson remained adamant that he would not be charged with either trespassing or destruction of property."

"This man has been scared," says the spokesperson, "and so were the thirteen missing children found in his car. All fourteen of them were exposed to the same sight that greeted their entrance to the world. Such things are simply not acceptable! After Dorothy built her house on this spot - a clear attempt to kill all thirteen missing children - her fate was sealed."

"Police also say that Dorothy was shot with a tazer nineteen times while resisting arrest. The officer that responded to Paul's distressed call reports that Dorothy was 'making loud noises' and 'trying to put her clothes back on'"

"I took it as a sign of instability. At any moment, she could have come at me!" the officer says, "Thank god that Paul was there, constantly taking photographic evidence. He has over three thousand pictures that show her naked body convulsing with shocks as the missing children screamed; I think the jury's verdict is clear already."

Some days, I am not proud to be an American.
