    Rumor: PlayStation 3s won't play borrowed, used, or rented games

    The official story: "We have made no official statement regarding coding for PS3 games."--Sony spokesperson.

    What we heard: Given the billions of dollars it sinks into its movie, music, and games divisions, it's little wonder Sony is big on digital rights management. The company has implemented anti-copying measures for years and has admitted it has been installing cloaking rootkits to hide DRM programs. (It has since issued a patch to remove the rootkit.)

    Those familiar with Sony's CD DRM practices were unsurprised when Joystiq reported that the company has patented DRM software that could prevent PlayStation 3s from playing used or borrowed games. The site cites US Patent #6,816,972, which is for "a device and method for protection of legitimate software against used software and counterfeit software in recording media." Specifically, the patented technology would verify that when software was inserted into a "machine" (read: console), it was registered to that machine. If it couldn't, the technology would prompt the machine to shut down, preventing the software from being accessed.

    Such measures would be fine and dandy, were they targeted at pirated software. But the patented tech--which bears the name of Sony Computer Entertainment president Ken Kutaragi--is specifically designed to prevent used software from being sold. "Since only titles for which legitimate software has actually been purchased and which have been initially registered in the machine table can be used, resale (so-called used software purchase) after purchase by an end-user becomes practically impossible," it reads. Such measures would also prevent lent or rented software from being played.

    But would Sony incorporate technology from Patent #6,816,972 into the PS3? On one hand, doing so would guarantee that each gamer would buy a new copy of each PS3 game, theoretically meaning bigger sales to help defray the steep cost of next-gen development. It would also remove the PS3 from the used-game trade, a market from which Sony gets no revenue.

    However, there would be some major drawbacks to implementing Patent # 6,816,972 technology into the PS3. It would mean forfeiting the rental market to Microsoft's Xbox 360. Though there are signs that the game-rental stories are in decline--Blockbuster Video is reportedly shopping around its GameRush subsidiary--Netflix-esque services like GameFly are gaining in popularity. Then there's the fact that many people can't afford to buy a whole lot of games. When presented with a choice between a console that does play rented games and one that doesn't, which way do you think they'll go? There's also the risk of sparking a blacklash like the one currently raging over the BMG DRM rootkit.

    Bogus or not bogus?: Sony has the technology, but it's too early to tell if it will use it.

    And how exactly will they be able to tell the difference from a game you bought new to a game you rented or borrowed or bought used?

    I would not take this to heart until Sony says it themselves. That would equate to cutting your nose off to spite your face.

    Actually, that doesnt even deem worthy of a response or posting of. BUT I DID IT ANYWAY!

        This may be entirely false... but isn't it illegal to rent or sell used games in Japan?

        Edit: Oh yeah, they would tell your game isn't new because once you play it in one machine, it imprints a code and when the code doesn't match the machine, the game won't play. This would mean that games only play on the first machine you put them in. Although a lot of people are distrustful of Sony, they aren't going to do this.

          I don't really have a problem with this because I don't rent or buy used games all that often. The not being able to borrow games from friends kind of bugs me but not really.
          The Cyclops having only one eye, needed to seek shelter from the harsh sun. The shadow cast by the spheres gave him temporary respite.

            While Sony does have a patent, it's unlikely that they'd implement it in such a manner. We'll just have to wait and see.

            On the bright side, though, Sony apparently plans on making the PS3 region-free.

              I ONLY buy used games, so this would totally turn me off of the PS3. But I can't see them seriously doing this, I mean, it's commercial suicide.

                Not for Sony. Directly, anyway. They only make cash off new sales, not pre-used sales or borrowed/lent games.

                  I disagree. They don't make any money off the rentals or used games so they're not going to loose money with that market. The only thing that's going to hurt them is console sales. I think their are enough people who either aren't going to know about this or won't care enough for it to affect sales. What this does is add pressure on them to have the games to back such a move up.

                  I stress the point that there's nothing more than rumor at this point, but they can't loose money on used games or rentals anyways. I predict that if this does happen people will protest at first but eventually take it. Besides the video game market isn't us anymore, it's the pop-a-coller college guy who buys games.

                        But where do all the rented games come from? The video store has to BUY them, from Sony, usually at INSANELY inflated prices. Imagine, a certain title is released, and each store in a chain of 10,000 stores gets ten copies, all of which they need to buy directly from Sony. That's 100,000 copies of a game. And that's one of a countless number of chains doing this. 100,000 copies alone makes or breaks a game's success.

                          A lot of people make their purchase decisions based on rentals or borrowing so they don't buy a game they'll end up not liking. I doubt Sony would use DRM the way this article suggests. It seems to me more like the corporate practice of getting a patent on something just so that you have the patent. Whether you plan to use it or not. After losing that lawsuit with the company that patented the Dual Shock capability I think Sony's extra cautious about patents and copyrights.

                            Half of my PS2 collection comprises of used games. If I couldn't get them used, I probably wouldn't have bought them. The ones that aren't used were simply games that I needed to have immediately (RPGM2) or for Christmas (Ratchet 3), or were on shelf for some time but used copies just weren't available for one reason or another (Breath of Fire 5).

                              Yeah, I buy alot of games from pawn shops, this would definitly make a change in my decision of ever purchasing a PS3.
