I really don't know how lenient or harsh I'd be if I were the judge or jury in this one.

i agree here, but the law must be upheld, even in a case like this. the whole case is tragic. i wonder if the sex was consensual to begin with. a lot like to experiment, but the law calls minors having sex a rape. no one wins in any of these cases, there is just more victims and more sadness.

I can see when it's two teenagers but I don't the idea of consent should even be considered when it's an 8 year old.

Not to say he deserved it but at least he did something to earn it. The same and worse happens to so many people who are completely innocent in situations like hazing, bullying, hate crimes, etc. A lot of people in today's society usually say they hope something like this happens to child molesters in prison anyway so I wouldn't be surprised if the stepdad gets let off or a really light punishment.

What kind of punishment do you guys think the dad should receive? (Not what you think he'll get, or even what you think is morally right, but what you would recommend as a juror, assuming he pleads guilty).

Should his son's punishment be any gentler in light of his being victimized on account of the crime he committed?

I believe the jury decides if they are guilty or not guilty, the judge decides how long the sentence is. But regardless... ouch.

This is one ****ed up scenario. I don't have an answer, but imagine what it must be like to be a judge. Imagine dealing with this then going home to your wife and kids. Jesus Christ people.
