Jenkins alleges that heavy equipment from Chisler Inc. ran over the pipelines before the explosion, causing the methane gas leak.

If that is indeed what happened, then he has a legit reason to sue. If there was nothing wrong with him smoking in the portable toilet, then he has a case. If he shouldn't have been smoking in there, that changes things.

the negligence is not in where he was smoking, but that the pipe was not found and leaking methane.

i would bace a judgement on if the company knew about the leak and choose to ignore it, thus endangering lives. even if this is the case, id not award anyone over 2million - and that would be pushing it.

I do not believe the guy is an "idiot" as the leaked pipe was beyond his knowledge and he had no reason not to smoke.

Man, unless he's seriously burned and scared for life I wouldn't award him more than six figures. If you seperate medical costs then I'd only give him $100,000 max.

It really hangs on if he's seriously injured. Of course if there some kind of warning about not smoking in the toilet. Then all bets are of.

This case at least has more to it than the guy who broke into an old lady's house, then injured himself trying to escape, and suing the old lady. Grrr...

Was this a public place where he was smoking? and if so, is there a posted sign saying "No Smoking"?

If there is a sign, he has absolutely no case, and better not get jack s***. If it is okay to smoke in the bathrooms, then, oh well, you still shouldnt be smoking on the can.

Edit: My bad, it says portable toilet. Still, why the hell would you smoke on a portable toilet? What are you? some kind of f***ing idiot? Those things usually have so much nasty stuff, not to mention smells, that i would rather crap my pants than use them. (i have a strong fear of public restrooms. the lack of cleanliness of most other human beings disgusts me).
