Smoking in public banned in Calabasas, California

I live near this city too. Although this is a nice idea to keep the people healthy (I can see this doing good in public parks where a lot of kids are present), there are still a lot of people who have every right to smoke if they want. So who knows how this will turn out.

Outdoor Smoking Ban Takes Effect Friday

    POSTED: 9:03 am PST March 13, 2006
    UPDATED: 10:15 am PST March 13, 2006

LOS ANGELES -- The city of Calabasas, northwest of Los Angeles, is set to enact one of the toughest smoking bans in the nation on Friday.

The anti-smoking measure, passed by the city council in February, promises to make Calabasas the first virtually smoke-free city in the country.

Although there will be designated smoking areas, the city has signs that essentially say smokers aren't welcome, and cards that non-smokers can hand out to remind smokers about the law.

Like similar ordinances, the law bans smoking in public buildings, but this law will include bus stops, parks and other outside areas where non-smokers are present.

Calabasas student Margo Arnold initiated the ban when she took a complaint to City Hall. She told NBC4 she doesn't smoke, but sitting outside one day, enjoying a meal, she felt like she did.

"There was just so much smoke," Arnold said, "there were smokers to my left and my right and I just got overwhelmed with having to sit out there and breathe the smoke."

In January, California declared secondhand smoke a toxic air pollutant.

Now Calabasas Mayor, Barry Groveman says the city is protecting the health of its citizens with the new law.

"This does not ban cigarettes, this limits public exposure to secondhand smoke," Groveman said.

The new law has plenty of critics.

"I think it's political correctness gone off the deep end," smoker Ed Souder told NBC4.

Even some non-smokers, like Linda Kutzin, agree.

"It's their prerogative to smoke if that's what they want to do," Kutzin Said.

According to NBC4, city officials are hoping smokers will get the message and it won't be difficult to enforce the ban. But the sheriff's department is ready to step in.

"What we're hoping is that this will allow it to be acceptable for someone who doesn't want to be impacted by smoke to say, 'would you mind putting that out?' knowing that they have the force of law behind them," said Groveman.

Violators of the ban could pay a fine of up to $500, while repeat offenders could face jail time.

Calabasas officials say they believe one day soon, laws like theirs will be the norm nationwide.

Thirty-six states currently have laws restricting smoking.

The only reason I agree with this part is because I have to endure endless smoke around me all the time at the bus stops. There are always at least three or more people smoking, and they never stand in the same place or downwind. Passengers and drivers alike walk on the bus while exhaling tons of smoke. I had to sit on a bus that was on a layover while three guys smoked black and mild cigars right outside the open doors.

I'm an ex-smoker, so I'll put up with a lot of ****, but I can't stand these inconsiderate bastards. We have a smoking ordinance in effect here, it just doesn't cover bus stops. I think this is a little extreme, but it's California, so is anyone really shocked?

Where I live, they also have banned smoking in public. I was very pleased by the law until I went to one of my favorite diners. Now you have to be 18 or older (which I am) because they allow smoking. The whole place is now covered in a thick fog. I have asthma so I can't go there any more.

I like that law...because second hand cigarette smoke bothers me. Not even just in the moral sense that I'm forced to inhale other people's freedom of expression or whatever...but also because I have a mild asthma.

I don't. I just really hate the smell of cigarette smoke, as well as the idea of breathing the stuff in. Stupid nicotine is the only thing that's preventing people from throwing the stuff away in one shot.

Yes boys and girls, smokers are second-class citizens. Dogpile on the smokers!

Get out of here, brownlungs! We don't need your kind here, stain-teeth!

                  I totally agree!
Denver is supposedly going to be smoke-free soon.
                  Good riddance, I say!

Just over this winter, here in Washington State, we had a new statewide ban of public smoking. That included, no smoking in public places, no smoking indoors (with the only exception being tribal casinos), and also no smoking within 25 feet from any door or window of businesses.

There was a lot of controversy and crap, but in the end, it wasn't that bad. Business wasn't declining, like many bars and clubs feared. There's all these designated smoking tents where people can go outside to smoke and not get drenched in the rain. As a non-smoker, I'm just glad to say I can now leave a bar/club without smelling like death.

Re: Smoking in public banned in Calabasas, California

Overall, I'd have to say that I am against the way this law is applied, and I don't even smoke.

The idea of banning it in places like public bus stops is a good idea, but banning it entirely in public is a bit on the extreme side.

Personally, I don't think this should be enforced on small businesses, but maybe instead those businesses that want to allow smoking should be allowed to do so, provided they display a sign showing that they allow smoking. The local government is asserting itself way too strongly. In an outdoors public area, it would be near impossible for the smoke to be noticable by others.

But then again, we also know the local government's intent with this, and they're seeking to legislate morality more than they are seeking to protect others from second hand smoke. This according to the mayor himself.

Soon the civil war between smokers and non-smokers will begin.

If I'm smoking at a bus stop or something, I usually stand far enough away for nobody to notice, but I still get evil glances every once in awhile... I'm not even sure if these people know what they're angry at.

But, yeah, I agree with public smoking bans for the most part... This one is going way too far, though. Luckily I think most city councils will be reasonable enough not to follow suit.

And oh man, I hate it if I'm all alone somewhere, smoking, and somebody comes and sits right beside me and asks me to move. We're giving these people too much power.

We're helping the smokers die a little slower.

Im all for it. I ****ing hate walking outside of a building around here to have 3-5 people standing around blowing smoke every wich way.

Hell, even in all the entrances of our mall, theres benches out front with signs that say "Thank you for not smoking in our front entrances. If you do wish to smoke please do so 25 feet from the entrance.". Guess who the only people ever using those benches are?

Like 20 freaking smokers all pilled on the benches hacking and coughing there way to a better future.

Well then maybe you just need a bi-law to outlaw being an inconsiderate jackass.

Re: Smoking in public banned in Calabasas, California

We have a law like this in Lincoln, but it only applies to being inside buildings.

I find it to be bull**** frankly, for a couple of reasons.

                              1) Some cafe bought a bus and placed it in it's parking lot for smokers, so they could eat and smoke without being bothered, or bothering other people. The city filed a lawsuit. Luckily, a bus isn't a building and the notion was struck down.

                              2) I used to go to a Hookah Bar, a place you only go if you want to smoke tobacco out of a hookah! Since it's a building, they tried to shut the guy down.

                              3) The guy, to get around the law made his Hookah Bar a "Private Club" where you had to sign an agreement that you were there and took full responsibility for any smoking or second-hand smoke you recieve while in the bar. Once again, they tried to shut the guy down. He had to move outside the city limits.

                              4) I go to bars to play Texas-Hold Em' Poker, and EVERYONE there smokes. They have to pause the games for smoke breaks because you can't smoke inside.

If this law applied to family resteraunts(sp, whatever), and not bars, it would be fine. People go to bars to smoke and drink, and it's the 2-5% of people that go there for dinner that are represented by this law. My dad always complained about smoke at bars when we would go watch a college football game. Guess what, Dad? Go someplace else if you don't like the smoke, you're being an ass.

^ Why? Because just about every bar in Lincoln that is a bar (Not a Bar/Eatery) has lost quite a bit of business.

Of course, this implies I smoke. I don't do it around people who don't smoke, and I wouldn't do it in a regular eatery, but banning it everywhere, or even trying to take down a bus sitting OUTSIDE the cafe is absurd. If you don't want to be around it, then don't eat on that bus, durrrrr...

Draygone: I smoke cigars because I like the taste, so it's not just Nicotine. I also smoke flavored cigarettes because they're damn tasty, so again, not the nicotine. Any brand of cigarette that's not Marlboro or any crappy American brand, but something like Gauliosses (French Tobacco) or Amsterdam Shwag is mighty smooth and doesn't taste like processed Marlboro Filter crap.
