    How is the government ****ing up?

    Everyone list your top ten list of things that you think our government is violating the constitution and what exactly they are doing that violates the constitution.

    For instance, We went to war with Iraq, it is unconstitutional because Congress did not declare war. I'd perfer it if you try to keep this a little more mainstream and not so much with the conspiracy theories.

    if you want to catch me on aim or send me an email(both in my profile) I'll explain why I want this list.

    If you don't think that the government is ****ing up or your are Elysion then you don't have to respond.

    Well, the "war on drugs" is a complete waste of taxpayers money, in my opinion. Not so sure if that counts as unconstitutional though.

        GOOD LIST OF 10 DEN!

        1) War on Iraq
        2) Attempting to Outlaw Gay Marriage (which I'm sure will happen.)

        Those are the ones that bother me the most, yeah, there are alot of other things. Social Security, and other bull****. But, I'm not exactly big on politics.

          Yeah, this is more focused on Terr but I figured I'd let everyone else get in on it.

            1: Patriot Act - Invasion of Privacy
            2: Banning Gay Marrage - Unequal Civil Rights
            3: Media Censorship - No Freedom of Speech
            4: Abstinance-Only Education - Moronic in itself, also goes against freedom of Religion and speech
            5: "Intelligent Design" ( Creationism ) only classrooms - Religious views tie once again into state agenda

              I've never been taught creationism, ever. The closest was a philosophy class where we talked about the possibility of both in that evolution is God's design. And I'm in the south no less.

                Me niether, but there are schools and classrooms that only teach Intelligent Design.

                ( or skip over evolution )

                ( or put stickers in all science books that say, "Evolution is not a fact, it is an unproven theory. )

                  I think in most cases that would be the school district or state government, not federal.

                    For instance, We went to war with Iraq, it is unconstitutional because Congress did not declare war.
                    AND because the U.N. Security Council did not approve of it, and we agreed to the Uniting for Peace Charter when we joined the U.N. Thus by not complying to U.N. demands not to attack, we are violating Article VI Clause II of the U.S. Constitution (To see how the law is violated, look at Article 2, paragraphs 3 and 4, Article 51, Article 92, Article 93 paragraph 1, and article 96 paragraph 1 of the Uniting for Peace Charter) . Also, use of Depleted Uranium violates the protocol additional to the Geneva Conventions and so does bombing residential neighborhoods(See Article 35 paragraph 3 and Article 51 paragraphs 1, 2, 4, and 5 of the protocol additional to the Geneva conventions). Approval by Bush to fund the construction of mininukes during this war violates the Treaty on the Limitation of Anti-Ballistic Missile Systems (See Article I and Article III of the Treaty on the Limitation of Anti-Ballistic Missile Systems) and the Treaty on the Non-Proliferation of Nuclear Weapons(Article I, Article II, Article V paragraph I, Article VI of the Treaty on the Non-Proliferation of Nuclear Weapons).

                    ALL of these things violate Article VI clause II of the U.S. constitution, as it explicitly states:

                    This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

                    It is. I will explain in brief covering just one of the amendments it violates, although there is much more violations of our constitution to it.




                    Anyway...


                    1) War in Iraq - Already explained (See Article VI, Clause II)

                    2) Federal Reserve and the fiat money system - Constitution explicitly states only the government can print money, and not a private corporation. (See Article I, Section VIII, Clause V)

                    3) Homeland Security Act - Allows government to force vaccinations on its citizens even if the vaccine is untested or dangerous(Section 304 and 307, 4th amendment violation), gives the Secretary of Homeland Security access to anything a witness states AND access to the names of confidentially protected witnesses(Section 710, 5th amendment violation). Furthermore, the constitution explicitly states The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. and The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people., thus this act also violates 9th and 10th amendments.

                    4) PATRIOT Act - Silencing of recdord holders in the event the government confiscates information about you without your consent(Section 215, 1st amendment violation), opening the possibility of classifying dissenters as terrorists(Section 802, 1st amendment violation), warrantless searches and seizure of personal records(Section 215, 4th amendment violation), no need for warrant or probable cause for wiretaps, confiscation of belongings, entry to property, government putting a specific person under surveillance(Sections 216 and 217, 4th amendment violation), allows detaining immigrants without court orders or warrants with no judicial oversight and allows suspension of Habeous Corpus(Section 412, 4th amendment violation), allows the government to try a non-military American citizen in a military tribunal, allows the government to force prisoners to incriminate themselves, allows the government to designate people as enemy combatants without allowing them to prove their innocence(See President Bush's Military Order, part of PATRIOT Act, 5th amendment violation), allows the government to detain immigrants or people stripped of their citizenship, denying them a speedy and public trial(Section 412, 6th amendment violation), leaves no oversight for those tried in a military tribunal(Section 236, 8th amendment violation due to no public oveersight to determine whether punishment is cruel and unusual). Furthermore, the constitution explicitly states The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. and The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people., thus this act also violates 9th and 10th amendments.

                    5) Multistate Terrorist Information Exchange(MATRIX for short) - Allows the creation of a large database on Americans living in varying states, taking people's personal information without their consent(4th amendment violation).

                    6) "War on Drugs" and its associated legislation(Justice Assistance Act, Anti Drug Abuse Act of 1988, ect.) - In Weeks v. United States(1914
                    )
                    the Supreme Court of the US ruled that the 4th amendment offered a "right without a remedy."; meaning that any evidence seized in violation of the 4th amendment would be encouraging police to violate constitutional rights. Since the war on drugs, in Chimel v. California, a search without a search warrant but only an arrest warrant was allowed(When a search warrant is required per 4th amendment), warrantless seizures of property from an automobile in Chadwick v. United States, United States v. Ross deemed warrantless seaches constitutional despite the 4th amendment spelling out it isn't, ect. The list goes on. All these cases mentioned had the government searching for marijuana.

                    7) FBI, CIA, NSA, DEA, ect. - Need I really explain in depth? Article I Section VIII covering the powers granted to government does not grant the government power to create such entities.

                    8) Gauntanamo Bay and other prisons where there are American citizens held without charges - Breech of international law in which detainees are supposed to be open to the media, ect. This also breeches Article VI Clause II and in the case of American citizens, the 4th amendment.

                    9) Denying Native Americans their sovoreignty(Do some research on Ward Churchill's lectures, for starters) - One example Ralph Nader mentions, in which an Alaskan Indian reservation was growing hemp for fuel and clothing and our government was sent in to destroy the fields and arrest those involved. It's their own damn land, *not* bound by U.S. law.

                    10) Denying of States Rights with various national legislation(Such as preventing any state except California from writing their own automobile pollution standards) - Self explanitory. Ask if you want me to provide and fully explain examples.

                            Terr, you know about the scandal where they sent guys to Mexico to douse the weed with herbicide and it ended up being brought to the US anyway and killing citizens, right?
