    Want to kill Doctors? Move to South Dakota.

    South Dakota is in the process of passing an amendment that would 'expand the definition of justifiable homicide to include unborn children'

    FOR AN ACT ENTITLED, An Act to expand the definition of justifiable homicide to provide for the protection of certain unborn children.
    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. That § 22-16-34 be amended to read as follows:
    22-16-34. Homicide is justifiable if committed by any person while resisting any attempt to murder such person, or to harm the unborn child of such person in a manner and to a degree likely to result in the death of the unborn child, or to commit any felony upon him or her, or upon or in any dwelling house in which such person is.
    Section 2. That § 22-16-35 be amended to read as follows:
    22-16-35. Homicide is justifiable if committed by any person in the lawful defense of such person, or of his or her husband, wife, parent, child, master, mistress, or servant, or the unborn child of any such enumerated person, if there is reasonable ground to apprehend a design to commit a felony, or to do some great personal injury, and imminent danger of such design being accomplished.

    Reading the law it just seems to amend the self-defense rule to include an unborn child. The concern is that misguided extremists could theoretically use the law as an excuse to kill an abortion provider, which the law obviously doesn't intend.

    But misguided extremists could theoretically use any law as an excuse to commit murder. That is why they are a)misguided and b)extremists.

    And the fact that the article outright calls it "a law that makes it legal to kill abortion providers" is absurd and makes me not trust anything Mother Jones says.

        I don't see why "Because its South Dakota" suddenly makes Ryner's point moot.

            Because South Dakota already has the most restrictive laws regarding abortion in the US, on top of this there are zero doctors in that state willing to do the procedure, and doctors that will must be brought in from neighboring states.

            Along with the above proposal, they're trying force women to take a lecture at a "crisis pregnancy center". CPC's are often run by local churches, and are horrifically misleading.

            I understand Ryners arguement, and hes right to an extent. But anti-choice forces have been trying to get several similar laws passed in the state for the past 5 years. Insert boiled frogs analogy here.

            Edit: Oh, and i made an error. A single doctor is flown into the state once a week to preform abortions(He is kept anonymous). He is required to have armed guards, due to death threats and attempted assaults.

              Well, the State Senator immediately removed the bill from debate after the political firestorm he got into, so this law isn't going to be enacted anywhere anytime soon.

              A.G. Sulzberger of the New York Times reports that House speaker Val Rausch confirmed a vote on the bill has been postponed indefinitely. A spokesman for South Dakota Gov. Dennis Daugaard (R) told the Times: "Clearly the bill as it's currently written is a very bad idea."
