For practical, monetary purposes, you're right, but legally the 4-year-old is the one liable, per the story. It would be hard to pin a negligence case on the parent in this case.

Parents watched/didn't watch as their 4 year olds ran over an old lady.

Parents are responsible for the actions of their kids.

Parents get sued because they're liable.

Child is 9 months over 4 years of age. Case can't be dismissed due to age as ruled by Judge. That's the whole point of the article. The parents are still the ones being sued here.

I want to know how the old woman didnt see them coming and move out of the way. Were they behind her? was she walking through a blind spot and didnt see until they were almost on her?

Why cant the family sue her for deliberately walking in front of 2 children what were racing their bikes down the street?

This is shady no matter the situation.

ridicules lawsuit. how can you sue a child? perhaps sue the parents for allowing this kind of situation but to sue a child? as legal guardian of the child it is their responsibility to make sure the children behave as they should. thus the parents would be the only possible ones responsible.

i find it lame that her "estate" is suing. without knowing specifics like if an ambulance was called, id say the whole thing sounds suspicious.

children do stupid things, its a fact of life, its why they are called children. parents can only do so much to keep them from doing idiot stuff. a case like this should depend entirely on how the parents where involved in this. ultimately i think this is just a waste of court time.

denmo that is an interesting opinion but it is wrong, and this whole thing is outrageous and dumb. for one thing who's to say that the old lady didn't just jump in front of the kids intentionally so that she could get some money from the courts. i am highly suspicious of her motives and think she should be ashamed of herself. secondly you cannot sentence kids to the death penalty, that's just stupid. if anyone should be killed it is either the old lady or the bad parents for making our country a toilet. it also doesn't help that we live in such a sue-happy society. next thing you know parents will let kids crawl in the streets and big corporations will sue the babies for front axle damage. in conclusion i do not know much about this case but i have very strong opinions about it.

Actually, I have good reason to believe that this old lady is actually an alien in disguise, and that he (a cross dressing alien) was plotting, along with Big Foot and the Legion of Doom, sue the parents in order to inflict psychic wounds on the child so that later she may be groomed to become an unwitting, but very vital, piece of a chain reaction that culminates an earthquake that opens up a fault line in the very vault of Fort Knox, giving the aliens, Big Foot, and the Legion of Doom the opportunity to steal all of the gold to continue their streak of terror across the world (but mostly lawyer fees).

Also the old lady is Jesus.

For anyone who is seriously blaming the old woman for not watching where she was going, can I get some of what you're on?

When you're riding a vehicle that can hurt someone (and really this applies to ANY vehicle)--even in the streets but especially anywhere else--you're responsible for watching where you're going and not running over other people that are pedestrians or on much less powerful vehicles (i.e. a sedan against a biker). (Obviously if you're in a car sitting at a traffic light and a biker looses control and runs into you, that's their fault, and you're not going to be successfully sued for it. That clearly wasn't the case here.)

If the other person did something stupid (as long as it's not something outrageously stupid that you never ever could have seen coming and couldn't react to), it may be a contributing factor to the accident, but it doesn't absolve you of all blame and you can get sued for it.

That's the law, and I'm damn glad that our law works that way.

Most of the time, if you hit someone while you're riding a bike, you'll apologize, make sure the other person is OK, and move on with your life. Rarely, the person WILL be badly hurt, and in this unfortunate situation you're responsible and you deserve to be. You screwed up. You're not a criminal and you're not going to go to jail for it (and why the hell would anyone suggest anyone in this story deserves to be locked up?), but you may need to open your wallet to make things as right as they can be.

For that matter, we don't even know whether they old lady did anything wrong. I feel awful for her and I do hope her family wins some compensation. I feel bad for the kids on the bikes & their parents too but in the end they're alive and well and it's their fault that someone else is not.
