Overtime pay in the video games industry? What's that?

I'm posting this in the free forum because it's more a question of labor then of video games.

So I saw this article today:

    http://www.joystiq.com/2009/04/06/ca...eiving-overti/

I've worked in the industry for almost 7 years now, and I've never EVER recieved overtime pay...I'm on salary and this is the standard. My roommate couldn't believe this, and based on the responses on the Joystiq thread, this shocks other people too. It's true I once got a amall completion bonus, but that wasn't much compensation for the 60 hour workweek I was pulling for months. Currently, I work overtime at least once a month (usually a few times and once until 10-12 due to more responsibility). Jurs recently I was given the equivelent of $10 for 3 hours overtime (and I'm lucky I got that). I wonder if they get paid overtime in the 3D movie business. The funny thing is I stay at my current company for the relatively small amount of crunch, as I know 60 hour workweeks was normal for bloated titles from another infamous developer (I work with a former employee from there and worked for them hellish hours outsourced through my company).

BTW, I'm not giving specific company names because I know the power of the internets. Anyone here at the Pav remembers the first incident that happened to me 6 years ago of what I posted here.

The thing is, this is standard...I've always been used to this, and people would KILL for my job (3D character animator)...that's why they can do this and DO do this on a regular basis. I do at times wonder how much our workers are getting shafted, and how much our higher-ups are runnning away w/ the cash, but all I can pretty much do is wonder.

What do you think? Is this just a harsh reality of being in a dream job or should something be done? The effects of the "EA Spouse" didn't exactly reverberate, but I'm sure those w/ jobs right now are just happy to be employed in our economic condition. Currently, California is the only state that has overtime pay laws, and looks like that's going away (if you're lucky enough to make $75k, geez...I know it's higher cost of living but damn).

They do it because they can get away from it. You guys should start a union.

P.S. this is where Magus posts a picture from There Will Be Blood.
The Cyclops having only one eye, needed to seek shelter from the harsh sun. The shadow cast by the spheres gave him temporary respite.

They drank it, broke the glass, then rubbed the glass in your face.

Can't OSHA get involved in this?

            This is why.

If you're on salary they can pretty much put you on overtime without paying you for it.

You pretty much agreed to it when you agreed to be put on salary.

Don't start a union. The last thing I want is periodic video game strikes because the devs aren't giving royalties based off digital downloads or something.

I hope Ubisoft gets unionized and goes on strike. FOREVER.

I know I'm an exception, but it wouldn't honestly affect me very much, since I don't have anything current-gen and I don't play PC games. Worst thing that would happen to me is, worst-case scenario, the strike forces the local store where I play cards/occasionally buy PS2 games to close.

As far as I know, overtime pay only effects hourly wages, not salary. And I'd imagine that if you switched to hourly, you'd find yourself getting shoved out the door before your overtime kicked in.
                        ...and that's why.
