Holy Crap....Can I Get Sued For Using Music On YouTube?

I just started a filmmaker's page on MySpace, but I couldn't upload a video. When I saw why, it turns out that it didn't because some of the music I used was copyrighted (although it came with the software).

This got me thinking...I plan on using already-copyrighted music for some movies/animations of mine. Since all of the films will be based on original series of mine (and therefore official).....can I get sued?!?!

Oh god, oh god, what if it's like that thing with JK Rowling and her fan and I end up in court but with Katy Rose or something and I break down on the stand crying like that fan did and I get broke because I'm only living off bagels and water right now and (trails off into Excel Saga-like rant).

as long as you stick to online video hosting sites, no. myspace won't let you upload something with audio that has been flagged as a copyrighted. and youtube will mute any videos with copyrighted audio.

you try going professional while doing that, and yes.

Well, I was just planning on using some music for a Ke's Tales or Eli Fifteen trailer....So I can't be sued for that on YouTube? (I mean, once I go professional, I won't do that sort of thing....At least, I hope I go professional someday.)

Look at all the hundreds of crappy naruto AMVs on youtube with Linken Park, and the like. I doubt those kids get sued.

you will not get sued. the worst that can happen at youtube is they take the video down. fair more likely that they would mute it though.

I don't get why they would care.

I mean, I know WHY they care, but I guess it's hard to imagine when we're not in their position.

                Done.

Good, I was mostly concerned about that issue because it would be an orignal series of mine using it, rather than footage of another, already copyrighted series.

(...Plus that whole thing with that JK Rowling fan left me a bit shell-shocked.)

jk is an idiot, she gave away her copyright to that site and encouraged it to produce that chotchka and is now trying to backtrack when she realized it wasnt what she envisioned. i think the book should be squashed though.

so far ive only seen people who download music from stuff like napster getting sued in the states. since your program came with the music, and they must have a license to incorporate the music into their software, then you cant get sued from that angle.

as long as your not trying to profit by using someone elses material then you should be ok. the worst that can happen is that they can contact you and ask you to shut it down before taking any kind of additional action. as soon as you try to sell it though, thats when youd have to tread more carefully.

Thank you Ωbright for the sig fix!

....Now I'm really excited to be putting out trailers! Flash is a good program, right? (Or have any of you used Anime Studio?)
