Yes, taking naked photos of yourself is a stupid idea, and sending them to other people is even more stupid, but getting arrested for it is the most stupid. Yeah, they messed up, but did they really do it for distribution on the internet or for money? No, it doesn't seem like it. What's the problem, aren't non-minors who distribute pictures of nude underage people also arrested?

Sooooo, they took the photos of themselves, then waited a few years? Or is it called "child" pronography because their under the "right to vote" age of 18?
Also, if they just printed the photos and placed them in their rooms, is it still considered child pornography?

what right does the school have to rifle through the phones to begin with? i can see the school taking the phone and punishing the student for using it during school hours but to go through the private data - to even look at pictures is just wrong. the school is overstepping its authority to enforce a rule.
yet i must focus on the main issue at hand which is the charges. i dont see how you can charge minors with manufacturing and possession when everyone in the case is still a minor. we know they are too young to understand the deeper ramifications, so why the hell are you charging them? educate them, impress upon them the seriousness of this practice - dont put them through the court nonsense.
id like to see this strange new practice stopped. pornographic pictures taken of young girls has so often come back to bite people in the ass later on. i dont want any daughter i might have thinking she has to fit in by distributing her body just to attract boys and popularity. education and prevention are the tools needed in this game - not court dates and jail time.

Anyway, this whole situation is silly. I think we had a similar thread before about a different incident. The way I thought about it before still stands. It was increadibly stupid of them to do that and they should be punished... by the school system. Arresting the poor girls for that is kind of dumb. But hey, what do I know? In the U.S. the age of 18 marks legal adulthood. Pornography includes depiction of erotic or sexual material with the intent to cause physical excitement or emotional arousal in the viewer. If children (legally speaking, thus those under the age of 18) are depicted, it becomes child pornography. It has nothing to do with who is holding it or where it is hung (here you could segue an art v. pornography debate in some cases, but that's what the judicial system is for, to interpret the laws).
Now, I think it's not in the spirit of the law to charge these teenagers with producing/possessing child pornography, but it certainly follows the letter.
The problem becomes precedent. If you exercise clemency or even leniency in a case like this, you create a precedent that could be used to weasel actual offenders out of their malicious crimes. My father investigates cases of child molestation, abuse, and child pornography, which gives me a limited access into the legal/political aspect of these very complicated problems. Unfortunately, there are many "child" offenders (those under 18) in the world of child pornography and molestation. If these teenagers are given a pass, a good lawyer could get a similar pass for a 16 year old consumer of child pornography or even a 17 year old child molester.
