    Hey look, the US government is being ****ing stupid again

    On February 10, 2009 it will be illegal to resale any used children's products including toys and clothing. That is according to the U.S. Consumer Protection & Safety Commission who pushed for the new laws after dozens of toys were recalled in 2008 because of lead concerns.

          Do you really think they'll monitor every garage sale, ebay sale, thrift store sale, private sale, etc, etc, of children's clothes and toys? I doubt it.

          This is a dumb move, especially given the current economy. I'm sorry that the CPSC can't do their job, but the consumer shouldn't be punished for their inefficiency.

              I am sure this is just for stores (most likely just chain stores) and not for private selling.

                      It's being misinterpreted.

                      From my understanding, it will only be illegal to resell toys that failed the lead paint tests after february 10th (many of them are still being resold because the controversey makes collectors want them more). Toys produced after February 10th that don't have a notice on their packaging that they passed the test can also not be resold.

                      This one site out of texas is getting a lot of people confused. there's a big discussion in the toyark forum of tfw2005.com that straightens the whole thing out.

                      This explanation is taken from that topic, posted by Reeds:

                      Reading the Act, most of it is just revisions and additions to child safety laws. Where it does talk about toys with lead and future sales, there is no mention of retroactive enforcement. It is for when toys that are recalled due to high lead and phthalates percentages, those in homes must be flagged and unable to be sold due to the hazardous nature to infants and children under 12.

                      There is no mention or section dealing with prohibition of secondary toy sales that have passed CPSC requirements.

                      New safety standards. That's all.

                      This is because people holding tons of toys that will be banned due to the chemical phthalates in children's toys are causing these geniuses to sell off their stock like crazy now and they want that to be illegal a.s.a.p. As of Jan 1st, it already is in Cali. But Federally, this will make it so in Feb.

                      And to the Euro-geniuses, the EU did this ban years ago on phthalates.

                      So, freak out if you openly sell secondhand toys recalled by the Health Department. Otherwise, move along folks, nothing to see here.
                      doesnt effect me at all. no Hasbro product has ever failed the lead paint tests.
