    Four years after Janet Jackson’s right breast found itself freed before an audience of millions during a Super Bowl halftime show, the court room drama that ensued as a result, is finally over.

    According to E!, a federal appeals court threw out the $550,000 indecency fine against CBS Corp. heavily lead by watchdog group the Parents Television Council.

    During the 2004 performance with Justin Timberlake, Janet’s boob – with a star shaped pasty covering her nipple -- was flashed to 90 million viewers as Justin sang, “Gonna have you naked by the end of this song."

    He later famously referred to the incident as a “wardrobe malfunction,” but the FCC didn’t buy it and hit the network and its affiliates with the huge fine.

    A three-judge panel overturned the fine though, saying the FCC had overreacted and ignored its 30-year practice of only fining for indecent programming that is "pervasive as to amount to 'shock treatment' for the audience."

    The Parents Television Council is infuriated by the decision. (Bonanza's comment: Tough sh--. Shut the hell up)

    "While we are not surprised that the legal venue hand-picked by CBS would rule in favor of the network, the court's opinion goes beyond judicial activism; it borders on judicial stupidity,” said Tim Winter, president of the PTC. "If a striptease during the Super Bowl in front of 90 million people— including millions of children—doesn’t fit the parameters of broadcast indecency, then what does?"

    No immediate comment from the FCC, CBS, Jackson or Timberlake was available.

    That's far too much money for such a frivolous case. I mean, sweet jesus do you know how much good could be done with $550,000?

      The FCC passed some bull law to raise the fines to that much, Alto. They just wanted a scapegoat. I told the Pavilion four years ago, and they wouldn't listen. I'm just glad this ordeal is over.

          I listened, I just didn't comment. Sorry, but I don't like to follow celebrity affairs outside of their work. I'll watch their movies, read their books, and listen to their albums. I don't care what they do as long as they put on a good show. I saw the dance number Janet did for that, and it was a good show. Not knock yourself out good. But still good.


          Edit - I feel I should clarify though, if i like a musician/actors/director/writers work enough I will check and see what political actions they support. If I agree with the things they follow, I'll give my name to the cause. I found Exit through Radiohead and a few local causes from local bands.

              Janet Jackson is disgusting anyway, nobody wanted to see her tits no matter what age.

              PTC has a right to be angry, so do many parents. On a highly televised event like that, you'd expect the performers to show some courtesy to their viewers. The whole thing stank of a publicity shock-value stunt. I wonder how much Janet got payed to do that.

              Maybe it was $550,000.




              Also Bonanza, I hate to say it but I'm not surprised at where you stand on this. I've come to expect it from you, what with your support of Boondocks, BET, and basically anything Black Media.

                    Your theory has some merit, but it has flaws, Den.

                    Point A: My support of The Boondocks- You're absolutely right. I do support Boondocks, despite the fact that of its gratuitous use of the N-word and laced profanity. There is absolutely nothing, and I mean, nothing, that will sway me from that statement.

                    Point B: My support of BET- You're partially right, and when I say, partially, I mean that you have one slice of the pepperoni pizza out of the whole goddamn pie. Now, BET...well, I'll admit, I used to watch it like a saint back in the late 90's to the early 2000's. Music videos were looming, they had music that I liked, and it was a time where my mind had not yet conceived that this channel would turn into such a clusterf__k of MTV ripoffs: The 106 and Park (TRL ripoff), the Hell Dates, and other ridiculousn programming. If you ask me now if I support BET in contrast with my views in 2004, the 2004 me would say yes and the current me would say no, no no.

                    Point C: My support of Black Media- Michael Jackson, R. Kelly, Al Sharpton, Farrakhan (sp), Jesse Jackson. These are merely examples, Den. Yes, I have supported both R. Kelly and Michael Jackson in their respective cases, and gave celebratory topics when both men were found not guilty. That does not, however, mean that I was so close-minded, that I ruled out the possibilities that one or both of these men could have done these alleged crimes. Now, as for Al Sharpton and Jesse Jackson, I used those names as a means of downplaying your argument. Jesse Jackson and Al Sharpton can both kiss the hairy cheeks of my ass. I don't like them, I have no respect for them.

                    Is race a possible factor in Bonanza giving support for some people and respite for the other? I truly wish it wasn't a motivator. I keep telling myself that I shouldn't bias someone due to ethnicity, race, sexual creed, and other traits. The truth, or rather, my belief is this: I believe that Janet was used as a scapegoat for the network television programs to dictate what can and cannot be shown on television, the primary reason behind "live" shows running on a goddamn 5-second delay, and particularly, why the American public became so goddamn anal, it's not even FUNNY. That's how I feel. So, Den, you've come to expect it from me, yes? I don't really give a flying ****. Label me however you want. I could go on forever in this topic, but I'm missing wrestling. Let me know if you have any further theories or inquiries about my mindset.

                        What I can't understand is why it has to be some crazy 'scapegoat' conspiracy by the media against Janet Jackson, who happens to be black, a singer, and sister of Michael Jackson. If she wasn't any of these, would that change your position? Why can't it just be, "It was a shameful act. Shame on her and Justin for letting it happen, shame on the media for letting it on TV."

                            You're right, Den. It was a shameful act. I think the cards would have been played very differently if there were contrasts in the status of the individual. I've seen pretty of indecent material on television (Sex and the City--I know, bad joke) go unpunished by the FCC, and I strongly believe that this Half-time show was a scapegoat plot. It's simply my opinion, Den; you don't have to agree with it. However, as I earlier stated, you have brought to light some valid points to your statements.

                              I'm all for bare breasts being a societal norm, but it isn't. They knew what they were doing and that it would make thousands of parents knocking at their door. They get whatever they deserve.
