Man with Medical Marijuana loses children.

    http://stopthedrugwar.org/chronicle/...hildren_naulls

Ronnie Naulls never saw it coming. The church-going businessman, husband, and father of three young girls knew he was taking a risk when he opened a medical marijuana dispensary in Corona, a suburban community in the high desert of Riverside County east of Los Angeles.

Although he had played by the rules, obeyed all state laws, and successfully battled the city in court to stay open, Naulls knew there was a chance of trouble with law enforcement. He knew there was a chance of the federal DEA coming down on him, as it has done with at least 40 other dispensaries this year alone.
After reading the article, the message this sends to me is: 'break the law? the government will kick your ass and take your kids.'
    ...and that's why.

i dont understand here. if he is playing by the rules and the law how come he is being charged and why did they storm his residence? what investigations where done and why?

if this is such a dangerous business (as the story seamed to suggest that it was risky) then why isnt the government fully incharge of it?

Thank you Ωbright for the sig fix!

The only thing he's not playing by the rules is the fact that he has marijuana. Otherwise he's a law-abiding citizen and a loving father.

      I don't understand your question.

        How horrible.

Well he should have saw it coming I guess. Everyone knows not to get in the way of the big time dealers in this country... Like Bush.

I think he meant that if medical marijuana were legal in California, and he was going about dispensing it in the legit way, then why was he being prosecuted?

You guys have to understand that some states, such as Oregon and California have Medical Marijuana laws, which allow growers and patients to help each other out, in highly-regulated state-legal operations. These state-laws are basically worthless to the federal government, as it is still against US law to grow and dispense marijuana.

The feds have been busting completely legal growers, doctors, and patients in the name of "the war on drugs".

All in all, it's complete bull****, and this shouldn't be happening.

So basically it's legal on a state basis there but not legal on a federal basis? That's ****ing bull****.

how the hell does that work? wouldnt the law be fully void? fed trumps state, so the law shouldnt of been passed and stands void.

Ok, I misread the article when it said 'trouble with law enforcement', but then it said the federal DEA. I missed that.

A state law is passed. State officers, state judges, etc abide by state rules. Federal officers are allowed under a supremecy clause in the constitution to enforce federal laws and prosecute accordingly. It is not often that federal officers breach on state matters. Unless, of course, when it comes to hot topics like "Medical Marijuana" which doesn't exist, accord to the federal government.

And that's the US law system.

So much for state's rights. But you know, it works both ways. States have a right to ban whatever they want within their own jurisdictions (with certain limits). For instance, There are dry counties in several states which ban the sale of alcohol, which is not illegal on the federal level. They don't call in the national guard when that happens, just when the mayor of Humboldt county hands out medical marijuana for people who have legally obtained a prescription for it, and will go blind from glaucoma without it.

seams really dumb. would make more sense to have non conflicting laws. in a case like this its like saying the state will turn a blind eye but your still screwed if you get caught.

i wonder if that gap, loophole, work around was known to this guy? its safer to be that dealer on the street then it would be to set up a medical use only business.
